Terms of Service for DictationEasy

Welcome to DictationEasy! These Terms of Service ("Terms") govern your use of the DictationEasy mobile application ("App") and the DictationEasy website at dictationeasy.com ("Website") (collectively, the "Services"), provided by DictationEasy ("we," "us," or "our"). By downloading, installing, or using the App, or by accessing or using the Website, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Services.
1. Scope
These Terms apply to your use of both the DictationEasy App (available on the iOS App Store) and the DictationEasy Website hosted on GitHub Pages. Sections specific to the App or Website are clearly marked. References to the "Services" include both the App and the Website unless otherwise specified.
2. Overview of DictationEasy
2.1 The App
DictationEasy is a mobile application that allows users to dictate text, save past dictations, and access premium features such as Teacher Mode, ad-free experience, and more through in-app subscriptions. These Terms apply to all users of the App, whether using free or premium features.
2.2 The Website
The DictationEasy Website provides information about the App, including its features, download links, and support contact information. The Website is intended for informational purposes and does not offer the same functionality as the App.
3. Eligibility
You must be at least 13 years old to use the Services. By using the Services, you represent that you meet this age requirement and have the legal capacity to enter into these Terms. If you are using the Services on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.
4. License to Use the App (App Only)
We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes, subject to these Terms. You may not:
Copy, modify, or distribute the App or any part of it.
Reverse-engineer, decompile, or disassemble the App.
Use the App for any illegal or unauthorized purpose.
5. Subscriptions and Payments (App Only)
5.1 Premium Features
DictationEasy offers premium features through in-app subscriptions, including weekly and annual plans. These subscriptions are managed via the Apple App Store and are subject to Apple’s payment terms.
5.2 Billing
Subscriptions are billed in advance on a recurring basis (weekly or annually, depending on your plan). You authorize Apple to charge your selected payment method for the subscription fees. If a payment fails, access to premium features may be suspended until payment is successfully processed.
5.3 Cancellation
You may cancel your subscription at any time through the App Store’s subscription management settings. Upon cancellation, you will retain access to premium features until the end of the current billing period, after which your subscription will not renew.
5.4 Refunds
All subscription payments are handled by Apple, and refund requests are subject to Apple’s refund policies. We do not provide refunds directly.
6. Acceptable Use of the Services
6.1 General Conduct
You agree to use the Services responsibly and in compliance with all applicable laws. You may not:
Use the Services to engage in any unlawful, harmful, or fraudulent activity.
Upload or share content that is offensive, defamatory, or violates the rights of others (applies to the App; the Website does not support user uploads).
Attempt to gain unauthorized access to the Services’ systems or data.
Interfere with the functionality of the Services or other users’ experience.
6.2 Website-Specific Conduct
When using the Website, you may not:
Use the Website in a way that could damage, disable, or impair our servers or networks.
Use automated tools (e.g., bots, scrapers) to access or collect data from the Website without our permission.
Reproduce, duplicate, or copy any part of the Website’s content for commercial purposes without our prior written consent.
7. User Data (App Only)
Any dictation content you create or save in the App is your responsibility. We do not claim ownership of your content but may store it to provide the App’s functionality (e.g., saving past dictations). For more details on how we handle your data, please see our Privacy Policy.
8. External Links (Website Only)
The Website may contain links to third-party websites or services, such as the Apple App Store or our Privacy Policy hosted on GitHub Pages. We are not responsible for the content, privacy practices, or availability of these third-party sites. Your use of such sites is at your own risk and subject to their respective terms and policies.
9. Intellectual Property
All content, trademarks, and other intellectual property on the Services, including but not limited to the DictationEasy name, logo, and design, are owned by or licensed to us. You may not use our intellectual property without our prior written consent, except as permitted under these Terms.
10. Termination
We may suspend or terminate your access to the Services at our discretion if you violate these Terms or for any other reason, with or without notice. Upon termination, your license to use the App ends (if applicable), and you must stop using the Services.
11. Disclaimer of Warranties
The Services are provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee that the Services will be error-free, secure, or uninterrupted.
12. Limitation of Liability
To the fullest extent permitted by law, DictationEasy and its affiliates, officers, employees, or agents will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Services, including but not limited to loss of data, profits, or goodwill, even if we have been advised of the possibility of such damages.
13. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will notify you through the App, on the Website, or by other means (e.g., via email). Your continued use of the Services after the updated Terms take effect constitutes your acceptance of the new Terms.
14. Governing Law
These Terms are governed by the laws of Hong Kong, without regard to its conflict of law principles. Any disputes arising under these Terms will be resolved in the courts of Hong Kong.
